This Online Privacy Policy (the “Privacy Policy”) sets forth certain terms and conditions according to which URBAN MEDLEY as a “Controller” within the meaning of the General Data Protection Regulation (EU Regulation 2016/679), may collect, store and use certain information and data concerning or provided by anyone visiting the URBAN MEDLEY  Platform, and/or registering as customer . It also explains the conditions under which URBAN MEDLEY uses and discloses that information, and the User rights in relation to that information.

This Privacy Policy applies to all personal data collected by URBAN MEDLEY online through the URBAN MEDLEY Platform. This Privacy Policy does not apply to information or data that may be collected by URBAN MEDLEY offline.

This Privacy Policy is incorporated into and is a part of URBAN MEDLEY’S Terms & Conditions. The definitions used and described in article 2 of said T&C apply to this Privacy Policy.

1. What information may URBAN MEDLEY collect and when and for what purposes?

URBAN MEDLEY may collect and process personal data that a User provides by visiting the URBAN MEDLEY Platform, creating an account, on the URBAN MEDLEY Platform purchasing Products or requesting further services or information. Below, Users can read more about the exact data that URBAN MEDLEY collects, the purposes and the legal base of that collection, and with which third party Urban Medley data is shared.

A. Data URBAN MEDLEY collects from Users

In the event that a User is visiting the URBAN MEDLEY Platform without creating an account, URBAN MEDLEY collects the following personal data.

What data:

• IP address;
• Traffic data (information about a User’s online behaviour);
• Location data;
• In the event that a User reaches out and requests further services of information of URBAN MEDLEY, also a record of the correspondence and other communication data.

For what purposes:

URBAN MEDLEY collects this data to improve its online services and User’s browsing experience.

B. Data URBAN MEDLEY collects from Users

In the event that a User creates a user account, URBAN MEDLEY collects the following personal data.

What data:

• Full Name of the user
• Address of user

• Date of Birth of user

For what purposes:

URBAN MEDLEY uses the data to determine user’s eligibility for using the website.

On which legal basis:

When registering on our URBAN MEDLEY Platform by opening a user account, users are requested to explicitly opt-in and approve the collection of their data. Notwithstanding this approval, the processing of the data is necessary for the execution of URBAN MEDLEY services and to complete the agreement URBAN MEDLEY has with the user

2. With whom does URBAN MEDLEY share the information?

URBAN MEDLEY does not sell, trade, or otherwise transfer to outside Urban Medley any User’s personal data, except for the following.

URBAN MEDLEY may disclose User’s personal data to other third parties;

If and insofar as a User has given URBAN MEDLEY explicit written consent for such disclosure.

If URBAN MEDLEY is under a duty to disclose or share User’s personal data in order to comply with any legal obligation, or in order to enforce or apply the T&C’s and other agreements, of which the User whose data is disclosed shall be notified in advance.

If it serves a vital business interest of URBAN MEDLEY, in order to operate the URBAN MEDLEY Website or its Services, URBAN MEDLEY may exchange personal data with other companies and organisations for example for the purposes of fraud protection, credit risk reduction.  Such other companies and organisations shall qualify as “Processors” under the General Data Protection Regulation.

Non-personally identifiable User information may be provided to other parties; for marketing, advertising or other uses. URBAN MEDLEY does not disclose any of User’s personal data without User’s explicit and prior written consent.

3. How does URBAN MEDLEY safeguard the data that it collects?

The safety of User’s personal information is paramount to URBAN MEDLEY and URBAN MEDLEY uses a variety of common security methods in accordance with current data protection standards, to maintain the safety of User’s information when User creates an account, submits, or accesses User’s personal data.

URBAN MEDLEY offers the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into URBAN MEDLEY’s payment gateway providers (Stripe) database only to be accessible by those authorized with special access rights to such systems and are required to keep the information confidential.

4. How long will User’s data be saved?

URBAN MEDLEY does not save User’s data longer than legally permitted and is necessary for the purposes for which User’s data is processed. The length of time certain data is saved, depends on the nature of the data and the purposes for which they are processed.

5. Correction of User’s data and other rights Users have

A. Insertion, correction and removal of User’s data

On User’s request, URBAN MEDLEY shall provide User with an overview of User’s personal data known to URBAN MEDLEY. All Users of the URBAN MEDLEY Platform may review, update, correct or delete the personal data by doing so in their registration profile on the URBAN MEDLEY Platform or by contacting URBAN MEDLEY at unsubscribe@urbanmedley.com   and shall receive a confirmation that the email was received. URBAN MEDLEY shall remove or modify User’s data within 4 weeks after the confirmation has been sent.

If User would like URBAN MEDLEY to cancel User’s URBAN MEDLEY account URBAN MEDLEY shall attempt to accommodate such request insofar as no legal obligation or a legitimate business reason to retain the information contained in User’s URBAN MEDLEY Account keeps URBAN MEDLEY from deletion.

B. Making objections

If a User disagrees with a specific processing of User’s data, a User can object by sending an email to info@urbanmedley.com  at any time. After receiving User’s email, URBAN MEDLEY shall respond to User’s appeal as soon as possible, but at least within 4 weeks.

C. Data Portability

The right to data portability means that any User has the right to receive all personal data that URBAN MEDLEY processed of this User in a structured, current and machine-readable form and transfer it to another controller.

A data-portability request can be made by sending an email to info@urbanmedley.com  Upon receipt of User’s request, URBAN MEDLEY shall inform User about the forms in which URBAN MEDLEY can deliver the transferable data. The personal data requested by User shall be delivered in the requested form within one month, or within a maximum of three months in complex cases after having received the request from the User.

D. Withdrawal of previously granted permission

Any User that has given URBAN MEDLEY permission to process User’s personal data, may withdraw this permission at any time by sending an email to info@urbanmedley.com   URBAN MEDLEY shall reply and confirm such request for withdrawal of consent as soon as possible, but in any case, within 4 weeks after having received it.

This privacy policy may change from time to time, check back regularly to stay informed of any changes. URBAN MEDLEY will notify User by email (sent to the e-mail address specified in User’s URBAN MEDLEY Account) or by means of a notice on the URBAN MEDLEY Platform and Application prior to the change becoming effective. User’s continued use of the URBAN MEDLEY Platform or the Services, or accessing User’s account, following such changes, constitutes and signifies User’s full acceptance of such changes.

7. Cookies and other technologies used by URBAN MEDLEY

A. Why does URBAN MEDLEY use cookies and what type of cookies do URBAN MEDLEY use?

URBAN MEDLEY may use cookies and other technologies to collect analytic data, such as demographic information, personalize User’s experience on the URBAN MEDLEY Platform and monitor advertisements and other activities. Cookies are small files downloaded to User’s computer to track movements and behaviour within web URBAN MEDLEY Platforms.

The URBAN MEDLEY Platform may use cookies to:

• Keep track of User’s browser habit.
• Deliver content specific to User’s interests and other purposes
• Collect information on the frequency that certain promotions or digital activities are accessed, how much time is spent engaging certain informational content, and which links are clicked.
• Link cookie information to personal information.

URBAN MEDLEY also maintains log files which contain Internet Protocol (“IP”) addresses. In general, URBAN MEDLEY only uses log files to monitor traffic on the web URBAN MEDLEY Platform, to report aggregate information to advertisers and third-party service providers and to troubleshoot technical problems. In the event of User abuse of the URBAN MEDLEY Platform; however, we may block certain IP addresses or console IDs provided by licensed hardware manufacturers. IP addresses and console IDs may be used to personally identify Users in order to enforce URBAN MEDLEY’s T&Cs.

Other technologies used in the URBAN MEDLEY Platform include clear GIFs and IP address logging. Clear GIFs (a.k.a. web bugs, beacons or tags) are small graphic images placed on a web page, web-based document, or in an e-mail message. Clear GIFs are invisible to the User because they are typically very small (only 1-by-1 pixel) and the same colour as the background of the web page, document or e-mail message. URBAN MEDLEY does not use clear GIFs to collect personal data about any User. However, URBAN MEDLEY may use clear GIFs to capture statistical usage information for the URBAN MEDLEY Platform, web pages, features or other elements on a web page. URBAN MEDLEY may correlate this information to a user to personalize User experience and for statistical analysis of User experiences on the URBAN MEDLEY Platform.

B. Manage User’s cookies

A User can disable cookies or set a User’s browser to alert User when cookies are being sent. By using browser settings on User’s computer; User can delete already deleted cookies and refuse to post new cookies.

Note: If Users refuse and / or delete cookies, User may not always be able to use all of the features of the URBAN MEDLEY Platform. Additionally, refusing or removing cookies only affects the computer and browser on which User perform this operation. If User use multiple computers and / or browsers, the User has to repeat the above action (s) as often as necessary.
